Responsible employees are required to share all details of any alleged discrimination, harassment, sexual harassment, and sexual misconduct that is reported to them, that they observe, or that they otherwise have knowledge of. Santa Clara University employees are almost always responsible employees with respect to the entire SCU community, with the exception of those designated as confidential. To confirm your status as a responsible employee, please refer to pages 17-18 in the EO/TIX Policy.
Failure of a responsible employee to report an incident of harassment or discrimination of which they become aware is a violation of University EO/TIX Policy, and the employee can be subject to disciplinary action for failure to comply.
Also, it is the policy of Santa Clara University that all university employees, as well as volunteers and independent contractors who, in the course of their business or volunteer activity, have reasonable suspicion of child abuse or neglect are required to make a report as outlined in the EO/TIX Policy. This policy applies to all Santa Clara University locations and all University sponsored or hosted programs, events, and activities, including study abroad programs. If the impacted party is under the age of 18 and this is a case of suspected child abuse, report the incident to the County of Santa Clara Child Abuse Prevention Council by calling the Santa Clara County 24-hour Hotline: 1-833-SCC-KIDS (833-722-5437) or in the San Jose Area: (408) 299-2071.
Campus Security Authorities
Employees who have been designated Campus Security Authorities for purposes of compliance with the Jeanne Clery Disclosure of Campus Security and Campus Crime Statistics Act (“Clery Act”) should evaluate whether they have an independent obligation to report misconduct to SCU.
